What O includes

• This section includes activities that, by their nature, are normally carried out by the Public Administration and, as such, are essentially non-commercial activities, including general administration (the executive, the legislative, the tax administration, etc., in the three spheres of government) and the regulation and supervision of activities in the social and economic life of the country (group 84.1); defense, justice, foreign relations, etc. activities (group 84.2); and the management of the mandatory social security system (group 84.3).
• The legal nature is not in itself a determining factor for classifying a unit in this section, but rather the fact that it carries out an activity that, by its specific nature, is a prerogative of the State. Thus, some public institutions that carry out activities included in other categories of CNAE 2.0 are classified in the classes corresponding to the services provided, and not in section O - division 84, as is the case with teaching and health activities, which, even when carried out by the State, are classified in the corresponding divisions (85 and 86).
• The regulatory, control, or coordination bodies for these activities, however, are classified under Section O - Division 84. Similarly, some activities described in Section O - Division 84 may be carried out by non-governmental entities. The outsourcing of services or parts of services traditionally performed by the State may lead to the presence of business entities and private non-profit institutions in activities included in Section O - Division 84.
• Division 84 includes units that are entities created by law, with their own legal personality, that carry out activities supporting public administration in order to facilitate the management of public resources, providing support in areas of typical state function, in the execution of actions such as: procurement of goods and services, contracting of services for the purpose of economic and social development, administration and management of human resources, etc. They function as an appendage to bodies of the Brazilian Public Administration and must be classified in the classes where the bodies to which they are linked are included.
